Is hemp-derived delta-9 THC legal?
Under the 2018 Farm Bill, hemp-derived cannabinoids are legal on a federal level. While some states have taken steps to ban THC alternatives, there’s a bit of a legal gray area right now— especially when it comes to edibles.
In states where hemp-derived cannabinoids like CBD, CBN, CBG, Delta-8 THC, and THC-o are legal, delta-9 THC is legal thanks to a loophole in the laws. As long as delta-9 THC is extracted from the hemp plant (not marijuana) and contains less than 0.3% THC on a dry-weight basis, it complies with the Farm Bill.
With that in mind, it comes down to simple math. By infusing hemp-derived Delta-9 THC into edibles, they’re legal to sell as long as they weigh in at less than 0.3% THC. Each delta-9 product found in our store is under the 0.3% THC limit, so they’re legal wherever legal hemp products can be sold.
Full-spectrum vs. broad spectrum vs. CBD Isolate
There are many different types of CBD gummies out there. Knowing the difference between each of them will help you choose the right CBD for you.
Full-spectrum:
Full-spectrum hemp extracts contain the whole range of terpenes, cannabinoids, flavonoids, and other essential oils found in hemp. Because they have the entire range of cannabinoids and terpenes, full-spectrum tinctures support the entourage effect which demonstrates how these compounds are stronger when they’re taken together. Full-spectrum extracts may also contain CBG, CBN, CBC, and THC. These products can legally contain up to 0.3% THC. While they won’t cause you to get high, they may still show up on drug tests.
Broad-spectrum:
Broad-spectrum hemp extracts are a lot like full-spectrum extracts except they go through a purification process to remove THC from the mix. They’re still good for supporting the entourage effect as they contain natural terpenes and other minor cannabinoids, including CBN, CBC, and CBG. Keep in mind that CBN is a degraded form of THC, so broad spectrum CBD may also cause you to fail a drug test.
CBD isolate
CBD isolate is a fully refined hemp extract that contains nothing except CBD. Since it doesn’t contain any other terpenes or cannabinoids, it cannot support the entourage effect. However, CBD isolates are still worth taking, especially if you’re worried about failing a drug test but still want to find what feels good.
