Under the 2018 Farm Bill, hemp-derived cannabinoids are legal on a federal level. While some states have taken steps to ban THC alternatives, there’s a bit of a legal gray area right now— especially when it comes to edibles.
In states where hemp-derived cannabinoids like CBD, CBN, CBG, Delta-8 THC, and THC-o are legal, delta-9 THC (the one you know and love found more frequently in cannabis) is legal thanks to a loophole in the laws. As long as delta-9 THC is extracted from the hemp plant (not marijuana) and contains less than 0.3% THC on a dry-weight basis, it complies with the Farm Bill.
